General

These terms apply to websites appearing under any of the following domain names:

  • RockyMountMall.com
  • TheRockyMountMall.com
  • RockyMountMarketplace.com
  • RockyMountInformation.com
  • ShoppingRockyMount.com
  • ShopRockyMountFirst.com

These terms also apply to linked websites AKA “Advertiser Accounts”.

All contact information must be accurate and complete. If you change your phone number, email address or physical address you must update your web listing within 30 days. If you fail to update your information within the time allowed, you website will be placed on the inactive list and remain there until you have updated your information.

Liability

Neither Rocky Mount Mall nor Gold Rock Management or any of its subsidiaries or affiliations is in any way responsible for the content or accurateness of information available from any advertiser website herein. This is true even if an advertiser violates other portions of the “Terms of Use” agreement.

Each vendor or company is responsible for its own content, accuracy and all legal issues related to their business or content.

All vendors or companies listed here are responsible to meet all federal, state, county and city requirements for their business.

Member (Business) Categories

We currently offer four kinds of memberships:

Church/Civic Organization
Church and Civic Organizations may not sell directly from their websites if they use the standard free website. They may advertise sales or, they can upgrade to a Small Business website at a discount.

SOHO (Small Office/Home Office)
A Small Office/Home Office/Standard Site offers limited functionality. If you need more, you should upgrade to “Small Business) and charged at that rate for your website.

Small Business
A Small Business is technically a “Brick-and-Mortar” business and has a physical address where customers can come. A SOHO business can upgrade to a Small Business website but their home address will be shown.

Advertiser Link
An Advertiser Link is a link to another website. You must meet the same requirements as any other Member Business with the exception that you do not need to be physically local.

To be To be a member business (except for Advertiser Links), you must be in either Nash or Edgecombe county or have a toll-free phone number for sales or service and either Service the are through a rout or deliver to the area.

Returned Checks

There is a $45.00 returned check fee.

If your checked is returned for non-payment, your site and user account(s) will be disabled and you will have to cover the amount of your check plus the return check fee either in cash or by Pay-Pal before your site will be reinstated.

Website Development

The advertiser may develop their website utilizing the Point-and-Click Site Builder provided as part of all websites on our domains or they may elect to have us develop the site for them for a fee. Not all features of the Point-and-Click Site Builder are available on all website types.

Intellectual Property Rights

The design of this website both graphically and functionally belong to Gold Rock Management. Individual page content belongs to the advertiser who developed them with the exception that if the content of page was developed by Gold Rock Management, then the intellectual property rights belongs to Gold Rock Management.

Copying other websites

An advertiser may not copy and duplicate any other website content without the explicit permission of the developer of that website. This limitation is limited to graphics, intellectual content and functionality beyond navigation and themes (Only available on Small Business websites).

The exception to this rule is when a Small Business sells items manufactured by someone else. Then they must conform to the manufacturers rule on using images, logos and copywrighted content.

Selling Merchandise

Direct selling of merchandise is only allowed from a “Small Business” website (or Upgraded Church/Civic website). SOHO and Community Service websites may advertise events where merchandise can be sold, but may not make direct sales from your site. They may of course say "please call us".

Malware, Spyware, Viruses

No advertiser may place any software or links to software or other websites on their site that may be used to infect the visitor to their site with any form of Malware. Violation of this policy will bring about the immediate removal of their site from this domain.

Disallowed Content

This is a “Family Friendly” website. Site content is limited by the following:

  • No adult content can be on your website.
  • You may not link directly to another website that has adult content.
  • No “Child Pornography”, “Simulated child pornography” or other facsimiles of child pornography will be allowed. Nor will any links to any website offering any illegal information are allowed.
  • No “Hate” messages or organizations supporting or calling for attacks on individuals or groups are allowed.

Violation of “Terms of Use Agreement”

Upon notification of the “Terms of Use” agreement, the advertiser will be notified once the violation is verified. Per the terms of this agreement, the advertiser will be given 14 days to correct the problem (except for Malware, Spyware, Viruses). If the problem is not corrected to our satisfaction, we will make the site unavailable until the problem is resolved and you will pay a reinstatement fee.
